These Terms of Use (the “Terms”) govern the access and use of the website, mobile application, and associated services of Cuisinous (collectively, the “Platform”), operated by 9534-9072 Québec Inc., doing business as Cuisinous (“Cuisinous”, “we”, “our”, or “us”).
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
1. DEFINITIONS
“Platform”: The website, mobile application, and all associated services.
“User”: Any person accessing the Platform (Customers and Sellers).
“Seller”: A person offering food products via the Platform.
“Customer”: A user who orders or purchases food products.
“Content”: Texts, images, menus, reviews, or materials made available.
2. PLATFORM’S ROLE – DISCLAIMER
Cuisinous operates exclusively as a technological platform facilitating connection. Cuisinous does not prepare, deliver, or inspect food. All transactions exist solely between the Seller and the Customer.
3. ELIGIBILITY AND REGISTRATION
3.1 General Eligibility
You must be at least 18 years old and provide accurate information.
3.2 Account Responsibility
You are solely responsible for the confidentiality of your login credentials.
4. SELLERS – APPLICABLE AGREEMENT
Sellers are subject to a separate Seller Agreement which supersedes these Terms in the event of a conflict.
5. LEGAL COMPLIANCE AND FOOD RESPONSIBILITY
Sellers are solely responsible for complying with the law (MAPAQ, hygiene). Cuisinous does not guarantee the safety or suitability of the food.
6. ORDERS, PAYMENTS, AND FEES
Payments are processed by third parties. Platform fees are non-refundable, except where required by law.
7. CANCELLATIONS AND DISPUTES
Refunds are governed by the Seller’s policies. Cuisinous has no obligation to resolve disputes.
8. USER CONTENT
You grant Cuisinous a license to use the Content you post for the operation of the Platform.
9. PROHIBITED CONDUCT
It is prohibited to bypass the platform, commit fraud, or violate applicable laws.
10. SUSPENSION AND TERMINATION
Cuisinous may suspend or terminate accounts at its discretion without compensation.
11. INTELLECTUAL PROPERTY
All branding elements and software are the exclusive property of Cuisinous.
12. LIMITATION OF LIABILITY
Cuisinous is not responsible for allergic reactions, illnesses, or dissatisfaction related to products sold by third parties.
13. INDEMNIFICATION
You agree to indemnify Cuisinous for any loss resulting from your use of the Platform.
14. FORCE MAJEURE
Cuisinous is not responsible for delays caused by events beyond its control (pandemics, outages).
15. MODIFICATIONS
Cuisinous may modify these Terms at any time via publication on the Platform.
16. GOVERNING LAW
Laws of the Province of Quebec and laws of Canada.
17. SEVERABILITY
If a clause is invalid, the others remain in effect.
